We Work with Architects to Overcome Zoning Challenges  

Recently, our firm had the opportunity to assist an executive who wanted to build a luxurious dream home for his family complete with a +/-10,000 square foot residence, a horse-riding arena and barns to accommodate pet horses. While the project had a clear vision, identifying the ideal site and then resolving zoning challenges presented some hurdles along the way. 

The client’s architect had been in business for 25+ years with a specialty in luxury residential design. He had already been working on the plans but quickly realized that zoning issues presented potential for significant delays. The architect reached out and vetted us to make sure we had the experience to assist his client.  

 

What We Did 

1. Addressing Impervious Surface Limits & the AG Exemption 

One of the biggest concerns was impervious surface ratio (ISR) limitations – an issue that could have forced costly design revisions. Working closely with County’s Planning Officials, we were able to achieve the client’s goal with an AG Exemption, allowing portions of the property’s paved areas to be excluded from ISR calculations. This preserved the integrity of the original design while keeping the project compliant with zoning regulations. 

2. Rezoning to Accommodate the Project 

During our work on the project, the client found an even better site for their project, and as a result, abandoned the original plans. With the new site, property’s zoning designation needed to be changed to allow the residential and agricultural uses. We guided the client’s team by doing the following: 

Preparing and filing the rezoning application 
Presenting the case before the Zoning Board of Appeals (ZBA), where we secured unanimous approval 
Navigating the final approval steps with the Planning, Building, Zoning & Environment (PBZE) Committee and then with the County Board of Commissioners (unanimous approval). 

By carefully managing this process, we helped the client avoid unnecessary setbacks and delays, allowing the client to close on the property ahead of schedule. 

3. Keeping the Project on Schedule 

For the client and the architect, timing was a major concern. To keep the project on track, we: 

  • Proactively engaged with County Officials early in the process to confirm our understanding of the zoning regulations 
  • Ensured all materials were presented in a timely manner to keep the application moving along quickly 
  • Ensured the client’s project was placed on the first available agenda and that we secured approvals at every step of the way 

By staying ahead of potential issues, we made sure the project advanced as planned.
